TERMS AND CONDITIONS OF ENTRY
The following Terms and Conditions relate to the Jewellery Council of South Africa (“JCSA”) promotion outlined herein, in which entrants stand a chance to win prizes as provided by members of the Council.
By entering this competition, an entrant is indicating his/her agreement to be bound by these Terms and Conditions. Therefore entry into the competition will be deemed as acceptance of these Terms and Conditions.
- Promoter
1.1 The promoter is the JCSA whose registered office is at The Hamlet; 27 Ridge Road; Parktown; 2193.
1.2 Employees of the JCSA, its participating member/sponsor brands and/or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
1.3 The JCSA is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
- Entry
2.1 This competition runs from 14 January 2017 to 14 February 2017 and no further entries to the competition will be permitted after 14 February.
2.2 There is no entry fee and no purchase necessary to enter this competition.
2.3 The route to entry for the competition and details of how to enter will be heard on 5fm as well as published digitally at http://www.jewellery.org.za. The competition will also be advertised on Facebook.
2.4 No responsibility can be accepted for entries not received for whatever reason.
2.5 Participants may enter the competition as many times as they want to.
- Prizes
3.1 Winners will be chosen digitally through a random selection process via a landing page entry. Participants are required to enter their personal details on the website, following which there will be a random selection of winners running from 14 January until 14 February 2017.
3.2 Winners indemnify JCSA, its affiliates, respective directors, officers, employees, and agents from any and all claims, liability, loss, or damage, including any third party claims, arising from or relating to, in whole or in part, this competition or the possession, use, misuse of, or inability to use the prize.
3.3 All prizes are not transferable. No cash alternative to the prizes will be offered.
3.4 The participant agrees to abide by the decision of the judges, which decision is final on all matters pertaining to this competition. The judges’ decision will be made in their absolute discretion. No appeals will be entertained.
3.5 Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice. Subject to the provisions of the Consumer Protection Act, the specification of the prize in any advertisement may differ from the specification of the prize delivered and the winner of the prize shall accept the specifications of the prize delivered, which specification selection shall be at the sole discretion of JCSA.
3.6 JCSA will use its reasonable efforts to contact the winners telephonically or via email. This would entail making contact with the winners three times over three weeks, using both mediums of communication. If the JCSA is unable to contact a winner after such reasonable efforts to do so, that person’s right to the prize will be deemed to have been waived and the prize will be forfeited. In such a case, JCSA reserves the right to award the prize to the next randomly drawn participant.
3.7 The winner must be able to identify him or herself (in a manner determined by JCSA as the person that entered the competition) and will have to comply with the required validation procedures in order to claim the prize.
3.8 The JCSA may refuse to award the prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
3.9 The participant consents to any publicity which may be generated as a result of the competition, to use on any marketing material and in the media at any time, including use of the participant’s name in all related marketing and publicity promotion.
- General
4.1 In the event of a dispute with regard to any aspect of the competition and/or these Terms and Conditions, the decision of the JCSA is final and binding and no correspondence may be entered into.
4.2 The JCSA is not liable for any technical failures affecting participation in the competition. The promoter will assume no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.
4.3 The JCSA reserves the right to amend these Terms and Conditions at any time, without notice, and such amendment shall be deemed to have taken effect from the date of publication of the revised Terms and Condition on its website.
4.4 The JCSA reserves the right to cancel, suspend or terminate this competition, without notice at any time and no liability shall lie against JCSA in favour of any participant or third party arising from such cancellation, suspension or termination. Any violation or attempt to violate any of the above rules will result in the immediate disqualification of the transgressor.
4.5 This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. Participants provide their personal information to JCSA and not to any other media channel through which the competition is promoted.
4.6 All information relating to this competition, which may be published on any promotional material via media is covered by these Terms and Conditions. In the event of any conflict between the content of such promotional material and these terms, these Terms and Conditions shall prevail.
4.7 By entering into this competition, entrants are consenting to receive marketing communications from the JCSA and any of its Council members, as adjusted from time to time, and that any personal data be used for any marketing/non-marketing purpose and the participant acknowledges that this data may be transferred across borders of the Republic of South Africa to another country.
